GENERAL TERMS

Scope and formation of the agreement

These Terms of Service apply to all services offered by Claudia Groessing through claudiagroessing.com.

The description, scope, format, investment and specific cancellation conditions displayed on the relevant offering page at the time of booking, together with any individual arrangements confirmed in writing before payment, form part of the agreement.

Submitting an inquiry does not create a binding agreement.

For services that require an inquiry and personal confirmation, the agreement is concluded once I have personally confirmed the booking and the client has accepted the confirmed arrangement, unless a different point of formation is stated on the relevant offering page or agreed in writing. Payment is made in accordance with the payment terms applicable to the respective offering.

For services expressly available for direct purchase, the agreement is concluded once the client has completed the checkout process and payment has been successfully confirmed.

A different point of formation applies only where this has been expressly agreed in writing before payment.

Prices, payment and invoices

All prices displayed to private consumers include VAT. For business purchases, the applicable VAT treatment, including reverse charge where relevant, is shown at checkout.

Any additional costs, such as agreed travel or accommodation expenses for an in-person service, will be communicated and agreed before the agreement is concluded.

Payment is due before the service begins unless a different payment arrangement, such as payment by instalments or a bespoke payment schedule, has been confirmed in writing. Invoices are provided electronically.

Online checkout process

For services available for direct online purchase, the client selects the relevant offering, enters the information requested at checkout, selects the applicable purchase status and payment method, reviews the information entered and completes the purchase by submitting payment through the secure checkout.

Before completing the purchase, the client can review and correct the information entered using the functions provided within the checkout or by returning to the relevant field.

The contractual terms applicable at the time of purchase are made available electronically through this website. The client receives confirmation of the completed payment electronically. The client is encouraged to retain the applicable offering description, Terms of Service and payment confirmation for their records.

Agreements through the website and online checkout are concluded in English.

Appointments, cancellation and rescheduling

The cancellation and rescheduling conditions stated on the relevant offering page apply to the booked service and form part of the agreement.

Requests to cancel a service or reschedule an appointment should be sent to contact@claudiagroessing.com.

Statutory consumer withdrawal rights remain unaffected; also, see below.

Online sessions

Online meetings take place by Zoom or phone, as agreed. Clients are responsible for having a stable connection, suitable equipment and a private environment in which they can participate without interruption.

If a session cannot take place due to a technical issue on my side, it will be rescheduled without additional cost.

Nature of the work and client responsibility

My services are intended to support embodied, energetic, personal or creative exploration, depending on the offering selected. They do not constitute medical treatment, diagnosis, psychotherapy or psychological crisis support and do not replace care from an appropriately qualified professional.

Clients remain responsible for their own wellbeing, choices and actions throughout and following our work together. No particular personal, energetic, creative, financial or business outcome can be guaranteed.

Further information about the nature of my work is provided in the professional disclaimer on the Impressum page. Nothing in these Terms limits any liability that cannot legally be excluded.

Confidentiality and intellectual property

Information and materials shared as part of an offering are treated confidentially unless disclosure is required by law.

Original written, visual, audio or other materials provided as part of an offering remain protected by copyright. They may be used by the client for the purpose agreed within the relevant offering but may not be reproduced, sold, taught, distributed or shared with third parties without prior written permission.

For creative services, any specific usage rights relating to final deliverables will be agreed separately and apply once full payment has been received.

Data protection

Personal data is processed in accordance with the Data Protection Policy.

RIGHT OF WITHDRAWAL FOR CONSUMERS

The following provisions apply exclusively to clients who enter into the agreement as private consumers. They do not apply to purchases made on behalf of a business.

Right of withdrawal

You have the right to withdraw from the agreement within fourteen calendar days without providing a reason.

The withdrawal period begins on the day the agreement is concluded.

To exercise your right of withdrawal, you must inform:

of your decision through a clear statement, for example by email or letter.

It is sufficient for you to send your withdrawal statement before the fourteen-day withdrawal period has expired.

Online withdrawal function

You may also exercise your right of withdrawal through the online Withdraw from Contract function.

If you use this online function, I will send you without undue delay, by email, a confirmation containing the content of your withdrawal declaration and the date and time it was received.

Effects of withdrawal

If you withdraw from the agreement, all payments received from you will be refunded without undue delay and no later than fourteen days after receipt of your withdrawal statement, less any proportionate amount payable for services already provided following your express request for early commencement.

Unless expressly agreed otherwise, the refund will be made using the same payment method used for the original transaction. You will not incur any fees as a result of the refund.

Commencement of services during the withdrawal period

At checkout, you will be asked to actively select which of the following situations applies:

— PRIVATE: I request early start; if I withdraw, I pay proportionately; my right ends at completion.

— PRIVATE: Service begins after the 14-day withdrawal period.

— BUSINESS PURCHASE: Consumer withdrawal rules do not apply.

If you select the early-start option, you expressly request that the agreed service begin before the fourteen-day withdrawal period has expired.

If you choose to withdraw after the service has begun, only the portion corresponding to the work already completed up to the time your withdrawal statement is received will remain payable. This amount will be calculated in relation to the full scope of the agreed service.

Your right of withdrawal expires once the service has been fully performed, provided that performance began following your prior express request and you acknowledged that you would lose your right of withdrawal upon full performance.

For the purposes of this section, the service begins when I start performing any part of the agreed work. Depending on the offering, this may include reviewing submitted materials, preparing for a session, commencing a visual or written review, or undertaking other agreed preparatory or creative work before the first live session.

If you select that the service begins after the fourteen-day withdrawal period, no part of the agreed work will begin before that period has expired.

Business purchases are not subject to the statutory consumer right of withdrawal.

Accepting these Terms of Service alone does not constitute an express request for early commencement. That request is made separately through your active selection at checkout.

APPLICABLE LAW

These Terms of Service are governed by Austrian law. Mandatory consumer protections applicable in the client’s country of residence remain unaffected.
